How to find a good divorce lawyer

For somebody who is going through the divorce process, understanding how to find a good divorce lawyer, the qualities one should look for, the particular skills they bring to the table, and how you will work with them – is the first of several steps towards deciding which divorce lawyer to hire. As you probably know, finding a good divorce lawyer is an essential part of ensuring that you get the settlement you want, not a settlement that ruins your life, and this rings true for both men and women.

Divorce is a difficult situation, one that was not planned when you got married, but it is a fact of life in many American marriages, as well in as a significant percentage worldwide today. You must realize, a life ruined by making a poor choice of divorce lawyer is a real possibility. There have been many people who did not seek advice on how to find a good divorce lawyer but trusted advertisements and recommendations from friends, and have found this out to their detriment.

So, how do you go about finding a good divorce lawyer? First of all, you must understand the dangers of trusting flashy advertisements or personal references. Advertisements – even by lawyers – may be misleading, as every maritial situation is different for many reasons, and a good divorce lawyer for another person’s divorce is not necessarily a good choice for yours. Every divorce case is unique.

We recommend that you should use the following advice on how finding a good divorce lawyer – one which we believe is a reliable set of standards for finding the divorce lawyer you can hire with confidence that they will handle your personal divorce case properly.

First – and very important – find a lawyer who specializes specifically in divorce, ideally within a law firm which has a specialization in divorce and family law. A lawyer who has a specialization in divorce (and has years under his belt in this particular legal niche) will bring a greater depth of experience and expertise to the table than a lawyer who does not. This may seem obvious but there is also hidden danger you must be aware of.

Unlike the medical and other professions, there are no rules and regulations which states when a lawyer may or may not advertise themselves as a “specialist” in divorce law (or any other legal niche for that matter!) There are no regulations that must in any way substantiate that they are a specialist.

To protect yourself from hiring a self-proclaimed “divorce specialist” who is in fact a jack of all trades (lawyers can practice in any/several areas of the law they like) find a divorce lawyer who can provide you with proof that they are indeed a specialist in the field of divorce and family law. A genuine divorce specialist will understand your concerns and have the proof at the ready. We also strongly suggest that you limit your search to lawyers who work in law firms specializing in divorce and family law.

Second – Look for a divorce lawyer with extensive experience. Seek out a divorce lawyer who has been practicing for several years and has for the most part practiced mostly as a specialist in family law and divorce. Importantly, check that a divorce lawyer has sufficient experience in your state, as every state has it’s own peculiarities in Divorce and Family Law. Your prospective divorce lawyer must understand the laws of your state, and even better – your particular city or county.

Like anybody else, divorce lawyers may move around the state they practice in and even around the country for work and personal reasons. A new arrival in a law firm may be an excellent divorce lawyer but not yet up to speed regarding family law in your state or locality – so be prepared to ask about “local” as well as overall divorce law experience.

You must also be prepared to ask questions as you need to – find a good divorce lawyer with extensive courtroom experience. Do not assume all lawyers have it – they do not necessarily have to. If things go in the direction of a need to go to court, your lawyer’s familiarity with the system, the complexities of the process and what works best with particular judges will pay off greatly in terms of a successful and as painfree as possible outcome.

Further, a divorce lawyer with courtroom experience will know when it is in your best interests not to go to court because you failure and damage is likely, which will save you unnecessary cost and conflict.

Third – Find a divorce lawyer who succeeds in and out of court. Even the most aggressive divorce attorney will know when to suggest alternatives to court when there is another option which is more likely to benefit you. Similarly, a divorce lawyer with a reputation for success through mediation should be prepared to “get tough” when it is called for.

In simple terms, a good divorce lawyer would be considered a flexible lawyer with the skills to succeed either in court or in mediation. A good flexible divorce lawyer is more likely to help you receive the settlement you want and feel you deserve. Therefore, you should look for a divorce lawyer with a consistent record of success both in and out of court.

Fourth – Seek a good divorce lawyer for your particular case. Consider any areas of your divorce that may require additional special experience. As an example, if your situation has complicated or sizeable investments or retirement funds, you will want to find a divorce lawyer with abexcellent financial expertise, or easy and established access to this expertise, best if it comes from within the same law firm.

If you have children, you need to know the importance of finding a divorce lawyer with a particluar experience in divorce cases involving child custody and child support issues. Again, never make assumptions here. There are many divorce cases which do not ihave children involved, so many lawyers may have light experience in this area.

Finally – Find a Family lawyer with a proper “management style” or appropriate philosophy, for your divorce case. Finding a lawyer that you can work with, one that you can trust with your case is extremely vital as your divorce will be more difficult than it already is if you and your lawyer are continually at odds about how it should be managed. You would be surprised at the number of people who try to find out how to switch lawyers mid-divorce. If you want to avoid the frustration and conflict with your divorce lawyer, it is important to find a one who is “on the same page” as you in terms of what you consider the most appropriate approach for your case. You and your lawyer must both be working towards what you believe is the best outcome for you.

To know how to find a divorce lawyer with this in mind, consider the different aspects of your particular divorce case. For example, do you anticipate an amicable or contentious divorce? If you believe it will be contentious, is there any hope that your spouse will be open to compromise and cooperation? Are you willing and/or able to fund a divorce case lengthened by conflict? And importantly, if you have children are you prepared to prolong a divorce which inevitably affects them as well?
