While a divorce or dissolution legally declares the end of a legal marriage, a marriage that becomes annulled is considered to never have been legal in the first place for whatever reason. An annulment is a declaration that a marriage was never legally valid.  

Religious Annulment 

The lack of harm to a person’s religious standing is considered to be one of the biggest advantages to an annulment. There are many religions which dislike divorce strongly, and will shun a divorced person.  However, annulments are not associated with the same religious stigma as a divorce. 

However, the side effects of an annulment carry their own burden. The protections typically offered to a spouse leaving a valid marriage through divorce may not always be available to a marriage ending through an annulment. 

Annulment Process

Receiving an annulment is not, as commonly believed, based on a time limit, but is typically associated with shorter marriages where alimony or spousal support might not be considered appropriate and the property division usually is not as favorable as it would be in a dissolution of marriage or a divorce.  

This is not to say that benefits are never available as state laws vary, and this is where having a good divorce lawyer will be of benefit. For example, depending on the length of time married, one spouse may  have come to depend upon a shared lifestyle with the other spouse and may be entitled to spousal support, and a good divorce lawyer in your state would be able to get you the best deal possible. 

Dissolution and divorce benefits, however, are more well-known and more likely to be pursued by the average person. 

If there are children involved, or it is a case involving child custody annulment is an unlikely determination since courts are reluctant to grant annulments once there are children in the marriage. However, if one does receive an annulment, decisions such as child custody and visitation would need to be made just like they would be if the couple were getting a divorce.
